IMPORTANT NOTICE

On November 29, 2011, the UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF WISCONSIN issued a decision holding that certain products (listed below) sold by Life Technologies Corporation (“Life”) under a license from Promega Corporation (“Promega”) can only be used for Forensic and Paternity Use (“Licensed Use”).  Specifically, the Court held that the license Life holds from Promega does not include applications such as chimerism in the context of bone marrow transplant monitoring, classifying molar specimens, cell line authentication, cancer analysis, archeological and anthropological research, clinical research on inherited genetic and acquired diseases, and determination of fetal sex.  Accordingly, this notice replaces any other label license or use statement for the listed products only as those labels or statements relate to the use of such products under the Promega license.  Any other restrictions, such as regulatory restrictions, related to the use of these products are not affected by this notice.  If a customer has purchased any of the products listed below and intends to use them for purposes other than the Licensed Use, a separate license is required from Promega.  If a customer has any question regarding whether their intended use is within or outside the Licensed Use, please contact LicenseQuery@lifetech.com.
